Terms and Conditions

CUSTOMER ORDERS 

  • If the retailer cancels the customer order, the purchaser has the right to a full refund.  When the purchaser cancels the customer order, the purchaser is entitled to a store credit voucher equal to the amount paid so far, less any cancellation charge.  The cancellation charge is the full amount of the purchase price, if goods ordered are less than $10 in value, or 20% of the price if greater than $10.  Store Credits are valid for 12 months from date of issue.

  • If the Customer Order items ordered in specifically which are not stock items of the store, or items made to order, these goods are non cancellable. 

  • On goods arriving in store, the purchaser will be notified and will have 30 days to collect goods, Should the purchaser fail to collect the goods the retailer will contact the purchaser and advise that the goods will be cancelled after 7 days unless full payment is made within that time, unless prior arrangement has been made with the store.

  • Delivery dates given are only an estimate and from time to time a supplier may be out of stock or the item discontinued.  In the event the retailer will endeavor to replace the item or a full refund of any deposits made may be given.

  • Partial pick-ups are available as long as goods taken are fully paid for, and goods remaining still have a full 50% deposit paid.

  • It is the responsibility of the purchaser to notify the retailer of any change of their address or phone detail.

LAY-BY 

  • Lay-bys must be completed within 6 months

  • Payments are due on a monthly basis

  • If the retailer cancels the lay-by the purchaser has the right to a full refund.  When the purchaser cancels the lay-by, the purchaser is entitled to a store credit voucher equal to the amount paid so far, less any cancellation charge.  The cancellation charge is the full amount of the purchase price if goods ordered are less than $10 in value, or 20% of the price if greater than $10.  Store Credits are valid for 12 months from date of issue.

  • There is no cancellation fee if the retailer cannot supply the goods.

  • Should the purchaser fail to honour the lay-by terms and conditions (e.g. no monthly repayments) the retailer shall contact the purchaser and advise that the lay-by will be cancelled after 7 days of notice unless a payment has been received within that time.

  • Should the purchaser not pay outstanding monies due, the lay-by goods will be cancelled, goods returned to stock and any monies due, minus cancellation charge refunded to the purchaser.

  • It is the responsibility of the purchaser to advise the retailer of any change of address or phone number

  • Partial pick-ups are available as long as goods taken are fully paid for, and goods remaining still have a full 50% deposit paid.

RETURNS AND EXCHANGES

Please check all goods carefully upon acceptance as later claims for damage may not be accepted.  Manufacturing faults relating to products must be reported to the store within 7 days.

A business does not have to accept the returns of a product if the customer:

  • Has no proof of purchase (e.g. do not have a receipt)

  • Changes their mind about the product

  • Has damaged it

  • Knew or should have known about a fault when purchased (factory seconds, floor stock)

  • Has been installed

  • Is not returned in their original packaging

Circumstances in which the customer may be entitled to a refund, exchange or credit are if the products:

  • Do not do the job that you were led to believe they would

  • Do not match a sample you were shown or

  • Are not as they were described

Sale Items discounted 50% or more are not returnable or exchangeable - please choose carefully.  Floor Stock items are accepted by Customer as seen in store prior to purchase.

Returns/exchanges only accepted within 48 hours of purchase date with proof of purchase.

WARRANTY AND CONSUMER GUARANTEE

Manufacturer’s guarantees against structural faults are outlined on the manufacturers documentation supplied with goods or on the Manufacturer's website.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.  You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Subject to the above paragraphs, all express or implied representations, conditions, statutory guarantees, warranties and provisions whether based on statute, common law or otherwise, relating to this warranty, that are not contained in it, are excluded to the fullest extent permitted by law.

HOUSE ORDERS

A minimum of 50% deposit is required with full payment within 6 months from date of purchase on all house orders.  Goods can be stored at our warehouse free of charge for a period up to a maximum of 12 months.

TITLE OF GOODS AND RESPONSIBILITY

Title of goods does not pass to the purchaser until full payment is made.   Once the purchaser has taken possession of goods, i.e. the purchaser picks them up or they are delivered, Lightingales relinquish all responsibility of the goods and they become the sole responsibility of the purchaser.  If for any reason the goods must be returned to the manufacturer or the store, it is the responsibility of the purchaser, and thus must pay any costs associated with doing so.  If the goods are to be picked up by Lightingales a second delivery fee will apply.  If you choose a split delivery, additional delivery fees may apply.

DATABASE 

Lightingales record details of customers on its database and occasionally will send promotional material to its customers, if you do not want to be listed on this database please notify the store you made your purchase from.
